How are stamp duty and registration calculated?

Stamp duty is charged on the higher of the agreement price and the circle rate, and registration usually adds another 1%. On a ₹1 crore home bought by a man in a city, the total runs from ₹5,90,000 in Gujarat to ₹11,00,000 in Tamil Nadu. Women pay 1 to 2 points less in Delhi, Maharashtra, Haryana, UP and Rajasthan.

stamp = max(price, circle value) × duty% (+ cess on duty); registration = value × reg% (capped in some states); new house cost C = price + stamp + registration, counted up to ₹10 crore; net consideration N = sale price − transfer costs; LTCG = N − cost (or N − indexed cost); Section 54 (82): exemption = min(LTCG, C); Section 54F (86): exemption = LTCG × C ÷ N, at most LTCG; tax = (LTCG − exemption) × 12.5% (or 20% indexed) × (1 + surcharge) × 1.04

This page uses the same method as the Stamp Duty & Capital Gains Planner (India), which explains each term and assumption in full.

Worked example

A woman buys a ₹90 L flat in Pune.

  1. 1Dutiable value: the higher of the price and the ready reckoner value, ₹90,00,000
  2. 2Duty: 6% (5% duty, 1% LBT, 1% metro cess, less 1% for a woman) = ₹5,40,000
  3. 3Registration: 1%, capped at ₹30,000 = ₹30,000

₹5,70,000 in all, ₹90,000 less than a man would pay.

Frequently asked questions

Is stamp duty charged on the circle rate or the agreement value?

On whichever is higher. Every state publishes a minimum value per square metre: the ready reckoner rate in Maharashtra, the guidance value in Karnataka, the guideline value in Tamil Nadu and the circle rate in Delhi. If your price is lower, duty is charged on the circle value, and the gap can be taxed as income for both buyer and seller.

Which states give women a stamp duty concession?

Delhi charges women 4% instead of 6%, Haryana 5% instead of 7% and Maharashtra, Uttar Pradesh and Rajasthan 1 point less. UP's concession applies only up to ₹1 crore. Gujarat waives the registration fee for women buying alone, and Tamil Nadu cuts registration by 1 point up to ₹10 lakh. Karnataka, Kerala, Telangana, West Bengal and Madhya Pradesh charge everyone the same.
